Mountain Dew Ride with Thrill is organized by Varun Beverages Nepal Private Limited (“VBNPL”) and executed by Avani Advertising Pvt. Ltd. (“Agency”) hereinafter together be referred to as “Organizers”.

Individuals can participate and win a brand-new Yamaha FZ V3 (as defined in Clause 7) by purchasing Mountain Dew and sending the unique code behind the label via website or through SMS.

The Campaign is open and valid only for legal residents of Nepal over 18 years of age, residing in Nepal only (“Participant”).

Employees of the Organizers, its affiliates, and their immediate family members are not eligible to participate in the Campaign.

The Campaign commences from 15th May’25 and shall remain valid from 15th May’25 – 22nd July’25 (both days inclusive) (‘Campaign Period’) or as may be decided by the Organizers. Any entries received outside the Campaign Period shall not be eligible for the Prize and shall not be carried forward to any other promotional scheme ahead.

There shall be 08 (eight) winners in total (each a “Winner”) during the Campaign Period.

Individuals participating in the Campaign shall stand a chance to win the following Prize in accordance with this Clause 7 below:

The Winners of the Prize (each a “Winner”) will be announced every week for 8 weeks during the Campaign Period. Lucky draw will be announced as when it will be scheduled.
Color of the bike may vary from as shown in the advertisement based on availability.

A Participant may participate in the Campaign multiple times but is eligible to win only once under the Campaign.

To participate in the Campaign, the Participant must follow the below-mentioned steps:

Step 1: Participant(s) shall purchase Mountain Dew from any store within the territories of Nepal between the Campaign Period, send the unique code behind the bottle label, and submit through the website by scanning the QR on the label, after filling up the necessary details (name, phone number, email, address). The Participant(s) can also submit the code via SMS, where the SMS charge shall be as per the tariff fixed by Nepal Telecommunication Authority. The SMS charge shall be borne by the Participant.
Step 2: Participant(s) shall accept these Terms and the Promotion Privacy Policy to participate in this Promotion.
Step 3: Participants who have submitted the unique code correctly will be eligible for participating in the lucky draw and only one lucky winner will be announced in each draw.

Campaign Mechanism and Selection Criteria:

08 (eight) Participants will be selected in total from the entire Campaign.
By participating through entering the details on the website www.ridewiththrill.com or through SMS, it is deemed that the Participant has fully read, clearly understood and completely agreed to these Terms. The Participant unconditionally and irrevocably accepts and agrees to be bound by all these Terms. In the event that any person is found to be ineligible or in breach of these Terms, then Organizer(s) shall have the full right, but not the obligation, to disqualify such entries, with no obligation to compensate such a person in any manner means or way whatsoever.
The Organizers shall, via SMS or Phone Call, inform the Winners after they have been selected via lucky draw.
Entries that fulfill all the guidelines mentioned herein shall be considered as valid and eligible to win.
One (1) participant is eligible to win only one (1) Prize, irrespective of the number of unique code submissions he/she makes.
VBNPL shall not be liable for any delay or non-receipt of Prize by the Winner due to any act of third-party partners. For any delay, the Winner(s) have to deal directly with the third-party partners providing the Prize.
Participants will also be notified via SMS of the details of the Prize won and instructions on how to redeem their Prize.
The winner is responsible for payment of any applicable government gift taxes and/or other taxes associated with the Prize. If required, the Prize shall be released to the Winner only upon payment of the applicable taxes to the concerned government agency.
Organizers accept no responsibility for any tax implications that may arise from winning the Prize. Winners will have to bear incidental costs, if any, that may arise from redemption of the Prize.
Participants must bring along their identification and label with the winning unique code to redeem/receive their Prize within 72 hours of the notification to prevent forfeiture. If the Prize is not received within the said timeline, the Organizers reserve the right to cancel the Prize without any further notification to the Winner or without liability of any kind.
Any forfeiture exercised by VBNPL will be binding and final on the participants.
The Winner(s) shall be solely responsible to bear his/her travel expenses to come and collect the prize.
If a winner does not respond within 48 hours, the Organizer(s) reserves the right to select an alternate winner.

It is expressly clarified that any Entry which falls under any of the following criteria will not be considered a Valid Entry under these Terms and will be immediately disqualified from being eligible for the Prize:

Images or posts that contain any content that maligns VBNPL or any of the beverages of the brands owned by VBNPL;

VBNPL reserves the right to amend, modify or cancel the Campaign or any part thereof and these Terms (including without limitation, changing the Term, the Prizes, the structure of the campaign, etc.), and may discontinue the Campaign at any time without any prior notice, at VBNPL’s sole discretion, and without any liability on its part. It is the Participant’s sole responsibility to review these Terms periodically for updates or changes.

VBNPL assumes no liability or responsibility for:

Any errors, omissions or inaccuracies of content or Entry/ies or Participant’s personal details.
Personal injury or property damage of any nature resulting from Participant’s access to, Participant’s exposure to or Participant’s participation in the Campaign.
Technical failure or any other causes beyond the control of VBNPL.

At VBNPL’s request, Participants with valid entries as per these Terms agree to participate in all promotional activity (such as publicity and photography) surrounding the winning of the Prize, free of charge, and they consent to the VBNPL using their name, likeness, image and/or voice (including photograph, film and/or recording of the same), along with the use of their submissions in whichever form, in promotional material or in any media for an unlimited period without remuneration for the purpose of promoting this Campaign and promoting any products manufactured, distributed, marketed and/or supplied under the trademarks owned by VBNPL.

VBNPL shall not be responsible for any loss, injury or any other liability arising out of the Campaign or due to participation by any person in the Campaign.

VBNPL shall not be liable for any loss or damage due to natural calamities, Governmental actions, epidemic, pandemic, other force majeure circumstances and shall not be liable to pay any amount as compensation or otherwise for any such loss with respect to the Prize.

No portion of the Prizes offered under the Campaign is redeemable in cash. The Prizes are personal to the Winners and are also not refundable or transferable.

No Prize will be awarded if the information presented by the Participant(s) at the time of entering the Campaign, or at any subsequent stage, is factually incorrect. The Prize may be forfeited from the Winner if it is subsequently discovered that the Winner has received the prize in contravention of this Clause.

Successfully entering the Campaign and winning a Prize is subject to all requirements set forth herein.

Organizers' decision as regards the selection of winners and distribution of the Prizes shall be final and binding. No correspondence or any other claims whatsoever, in this regard will be entertained.

As a condition of availing the Campaign offer, the successful Participant may be required to sign any relevant legal documentation as and, in the form, required by the VBNPL in its absolute discretion, including but not limited to a legal release and indemnity form.

The Participants shall comply with these Terms and waives any right to claim ambiguity in these Terms and release, indemnify and hold harmless Organizers and their respective affiliates, advertising and promotion agencies, and their respective owners, agents, auditors, representatives, officers, directors and employees from and against any injuries, losses, damages, claims, actions, or any liability of any kind relating to, resulting from or arising from this Campaign or any product or prize/Event provided in connection therewith. The Participants agree to indemnify and hold harmless Organizers and its officers, directors, employees, and affiliated organizations, and their respective officers, directors, shareholders and employees, from and against any and all claims, demands, damages, costs, liabilities and causes of action of whatsoever nature that are based upon or arise out of any breach by the Participant of these Terms or the warranties and representations made by the Participant in this Campaign.

The Campaign shall be governed and construed in accordance with the laws of Nepal. All disputes relating to this Campaign shall be subject to the exclusive jurisdiction of Courts inside Kathmandu valley only.

Participants/Winners acknowledges, confirms and agrees that VBNPL shall not be liable for any claims made whatsoever by the Winners regarding the Prize and/or technical snags related to the Prize regarding the same and Yamaha shall be solely responsible for same and shall keep VBNPL, its officials and its business partners indemnified against any such claims.
